Filing an Arbitration Complaint

Requirements

Arbitration must be filed within 180 days from close of escrow. However, if the transaction has not closed, then it is 180 days from the time the facts giving rise to the dispute occurred.


Disciplinary Action

Both the Code of Ethics and Arbitration Manual require members to arbitrate disputes. Filing fee for an Arbitration Complaint is $250.00. This filing fee is non-refundable, however, you may submit your filing fee costs to the panel and they will take your filing fee into consideration when determining the award. Use of an attorney for arbitration is permissible however the association must be notified at least 15 days prior to the hearing. All brokers must be named in the arbitration since commissions are paid to the broker.


Procedure

Once a complaint is filed, RSR will contact all other parties and request a response to the complaint within a 15 calendar day time period. A required 21 day Notice of Hearing is given to all parties. All parties will attend a hearing conducted at RSR to present and prove their case to the. After such hearing, all parties are dismissed. The panel will deliberate and issue an arbitration award of arbitrator which mailed to all parties.
